Terms and Conditions

§1 Scope

(1) These General Terms and Conditions apply to all orders placed by consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB) via the REPTILARIS online shop.

(2) Any differing or conflicting terms and conditions shall not apply unless their validity has been expressly agreed to in writing.

§3 Offer and Conclusion of Contract

(1) The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

(2) By clicking the “Buy now” button, the customer submits a binding offer to purchase.

(3) The purchase contract is concluded as soon as the order confirmation is sent by e-mail.

§4 Prices and Payment Terms

(1) All prices are final prices in euros.
According to § 19 para. 1 UStG, no value added tax is charged (small business regulation).

(2) Shipping costs may apply in addition to the prices shown. These will be clearly communicated to the customer during the ordering process.

(3) The available payment methods are displayed in the online shop.

§5 Delivery and Shipping

(1) The production and shipping of the products are carried out on demand via our fulfillment partner Printful Inc.

(2) The delivery time consists of production time and shipping time.

Production time

Typically 5-10 working days , depending on the product and order volume.

Shipping times (by region)

  • Germany: approx. 5–10 working days

  • EU: approx. 5–12 working days

  • United Kingdom (UK): approx. 6–12 working days

  • USA: approx. 5–12 business days

  • Canada: approx. 6–12 working days

(3) The times indicated are non-binding guidelines and may be extended in exceptional cases (e.g. customs clearance, seasonal capacity, force majeure).

Fulfillment / Complaints

(1) Production, fulfillment and shipping of the products are carried out via our fulfillment partner Printful .

(2) In the event of transport damage or production defects, please notify us within 7 days of delivery, including informative photos, so that we can investigate the matter and make a claim against the fulfillment partner.
Statutory warranty rights remain unaffected.

(3) Returns may only be made after prior agreement with us and must be sent to the return address provided by us.
Unannounced or independently initiated returns to production or fulfillment sites cannot be considered.

§6 Retention of Title

The goods remain the property of REPTILARIS until the purchase price has been paid in full.

§7 Right of withdrawal

Consumers generally have a statutory right of withdrawal.
Details can be found in the cancellation policy , which is provided separately in the online shop.

§8 Returns and return shipping costs

(1) In the event of a cancellation, the customer shall bear the direct costs of returning the goods , provided that we have duly informed the customer of this and to the extent permitted by law.

(2) The customer is requested to return the goods complete , preferably in their original packaging and with all accessories. This is not a prerequisite for the effective exercise of the right of withdrawal.

(3) The customer may only use the goods to examine their nature, characteristics and functioning to the extent that would be possible in a retail store. The customer is liable for compensation for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for examination.

(4) Textiles : A loss in value may occur, in particular, if the goods are washed , worn (beyond mere trying on) , soiled , damaged , or returned with odors/stains . In these cases, we reserve the right to claim compensation for the loss in value .

§9 Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the customer is decisive or which are clearly tailored to the personal needs of the customer (e.g. products with personalization such as name, desired text, individual photo or customer-specific requirements).

§10 Warranty

The statutory warranty rights apply.

§11 Liability

(1) We shall be liable without limitation in cases of intent and gross negligence as well as in cases of injury to life, body or health.

(2) In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), our liability is limited to the foreseeable damage typical for this type of contract .

(3) Otherwise, liability is excluded to the extent permitted by law. Liability under the Product Liability Act remains unaffected.

§12 Color deviations and printing properties

(1) Due to the printing processes used (e.g. DTFlex printing), slight color variations may occur between the screen display and the final product.

(2) Such deviations do not constitute a defect .

§13 Data Protection

Information on the processing of personal data is regulated in the privacy policy .

§14 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law only applies insofar as it does not restrict mandatory consumer protection regulations of the country of residence.

§15 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§16 Final Provisions

Should any provision of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
